In this lawsuit, we see something all too common: a collection agency blithely ignoring a consumer's Debt Validation Letter.
In this case, it was Mann Bracken, but GC Services has been known to do this as well, especially in conjunction with its "cash cow" account with American Express.
In this case, the consumer took the added, and prudent, step of making sure a return receipt was obtained, proving that Mann Bracken received the letter.
Another cause of concern is the fact that Chris Diwan, an associate attorney with Mann Bracken has this disturbing habit of claiming Mann Bracken does not have certain records, and then being proven wrong.
What's going on? Is Mann Bracken merely incompetent, or are they liars?
In either case, the law is being broken. In addition, as lawyers, Mann Bracken have certain obligations regarding recordkeeping, those are clearly not being met.
What happens when Mann Bracken ends up in court? They settle out of court.
